Flocking Social Waiver and Release of Liability
In consideration of being allowed to participate in any activities, events, or programs organized or associated with Flocking Social and Kor Entertainment Group LLC, I, the undersigned participant, acknowledge, appreciate, and agree to the following:
Assumption of Risk:
I understand that participation in Flocking Social events, sports leagues, and social activities involves inherent risks, including but not limited to the risk of injury, disability, or death. I knowingly assume all such risks, whether known or unknown, even if arising from the negligence of the releasees or others, and I assume full responsibility for my participation.Release from Liability:
I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby release, indemnify, and hold harmless Flocking Social and its affiliates, Kor Entertainment Group LLC, their officers, officials, agents, volunteers, employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used to conduct the event ("Releasees"), with respect to any and all injury, disability, death, or loss or damage to person or property, whether arising from the negligence of the Releasees or otherwise, to the fullest extent permitted by law.Compliance with Terms:
I willingly agree to comply with the stated and customary terms and conditions for participation. If I observe any unusual or significant hazard during my participation, I will remove myself from participation and bring it to the attention of a Flocking Social official immediately.Medical Treatment:
I consent to receive medical treatment that may be deemed advisable in the event of injury, accident, or illness during my participation in Flocking Social events. I agree that all costs associated with such treatment will be my sole responsibility.Photographic Release:
I grant Flocking Social permission to use photographs, videos, or recordings taken of me during any event, in any media format, for promotional purposes without compensation or further notice.Refund Policy:
By participating in Flocking Social, you acknowledge that all membership fees are non-refundable, as we operate on a monthly membership basis.Governing Law:
I agree that this waiver is governed by the laws of the state in which the event is held and that any legal action or claim related to this waiver or Flocking Social events must be brought in the appropriate court of jurisdiction within that state.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
Assumption of Risk and Waiver of Liability Relating to Coronavirus/COVID-19
The novel coronavirus, COVID-19, or any other known or unknown public health issue, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments, along with federal and state health agencies, recommend physical distancing and have, in many locations, prohibited the congregation of groups and people. Flocking Social has put in place preventative measures to reduce the spread of COVID-19; however, the organization cannot guarantee that you, your children, or any other person will not become infected with COVID-19. Further, attending Flocking Social-sponsored activities could increase your risk, and your child or children's risk, of contracting COVID-19 or any other public health issue.
Therefore, if you choose to participate in any of the Flocking Social-sponsored events, activities, and/or programs, you are required to acknowledge and execute this Waiver for yourself, your child, and/or your children.
ACKNOWLEDGEMENT
By checking this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child or children and I may be exposed to or infected by COVID-19 by attending Flocking Social activities, and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at Flocking Social activities may result from the actions, omissions, or negligence of myself and others, including but not limited to Flocking Social employees, volunteers, program participants, and their families.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child or children or myself, including but not limited to personal injury, disability, death, illness, damage, loss, claim, liability, or expense of any kind that I or my child or children may experience or incur in connection with my child or children's attendance at Flocking Social activities or programming.
On my behalf, and on behalf of my child or children, I hereby release, covenant not to sue, discharge, and hold harmless Flocking Social, its officials, employees, agents, and representatives, from any and all claims, including all liabilities, claims, actions, damages, costs, or expenses of any kind arising out of or relating thereto I understand and agree that this release includes any claims based on the actions, omissions, or negligence of Flocking Social, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Flocking Social program.
